1. Agreement to Terms

By purchasing, downloading, or using the Core Notes plugin ("the Software"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the Software.

2. Merchant of Record

Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles the secure checkout process, local tax compliance, and billing-related customer service inquiries.

3. License Grant, Update Period & Validation

Upon successful payment, you are granted a non-exclusive, non-transferable, personal license to install and use the Software on devices that you personally own or control.

  • Perpetual License with Limited Update Period: Your purchase grants you lifetime use of the specific version of the Software available at the time of your purchase. Additionally, you are entitled to receive all feature updates, security patches, and compatibility updates released within exactly thirty-six (36) months from the date of purchase.
  • Hard Cutoff: There is a strict hard cutoff after 36 months for all updates. Beyond this period, you will no longer receive updates of any kind, including security fixes or compatibility updates for newer versions of Obsidian, unless a license renewal is purchased.
  • Update Checks: To automatically provide you with the latest features and security patches during your 3-year update period, the Software periodically connects to our servers (e.g., a daily automated ping). This connection checks for new versions using your license credentials. It is not required for the offline functionality of your current version.
  • Post-3-Year End of Life (EOL): Continued use of the Software after the 3-year update period has expired, without an active renewal, is strictly at your own risk regarding compatibility, stability, and security.

4. Platform Dependency & The "Obsidian Defense"

The Software is provided strictly "As-Is" for the Obsidian environment. We are exclusively providing a third-party plugin and are in no way affiliated with, endorsed by, or connected to Obsidian or Dynalist Inc. We are not responsible or liable for any breaking changes, feature deprecations, or security flaws introduced by updates to the Obsidian core application itself that may render this Software incompatible.

5. Intellectual Property

The Software, including its code, design, and associated intellectual property, remains the exclusive property of Weber IT. You may not modify, reverse engineer, decompile, or create derivative works based on the Software.

6. Licensing & Security

Upon purchase, the generated download of the Core Notes plugin is secured and embedded with a unique anonymous digital identifier. This identifier does not contain plain-text personal data but uniquely links the licensed file to your transaction to trace the origin of the file and prevent piracy.

The distribution, sharing, public hosting, or unauthorized reproduction of the Software is strictly prohibited. Any detection of your personalized build being shared publicly or distributed without authorization will result in the immediate and permanent termination of your license, automated revocation of access to the Software and future updates, and may lead to further legal action.

7. Refunds and Automated Revocation

We offer a 14-Day Money-Back Guarantee. If you are unsatisfied with the Software, you may request a full refund within 14 days of your purchase by contacting us or Paddle. Important: Upon processing a refund, the Active Token linked to your anonymous digital identifier will be set to a revoked state on our servers. This will immediately disable your access to premium features, block all future updates, and terminate your license to use the Software. We retain the anonymous digital identifier indefinitely strictly to protect our intellectual property and prevent fraudulent re-purchases or piracy. You must delete all local copies of the Software upon receiving a refund.

8. Data Minimization & Deletion Requests

When you purchase the Software, your email and transaction details are used to process your order. This is strictly required to deliver your initial purchase (via a 24-hour download link) and to manage your purchase. Our primary license database exclusively uses a one-way anonymous digital identifier to authorize your daily updates without storing cleartext personal data.

If you exercise your "Right to be Forgotten" (e.g., under GDPR or FADP), we will permanently delete all of your cleartext personal records from our systems. Your current software license and update access will remain active. We will retain your anonymized transaction records and anonymous digital identifier. Because this identifier is irreversibly obfuscated and does not exist in plaintext, it does not constitute personally identifiable information (PII) under applicable data protection laws. This anonymized data retention is strictly necessary to ensure the delivery of future plugin updates for the remainder of the update period (up to 36 months). Furthermore, this fully anonymized data is retained for the full duration of your lifetime license to protect our intellectual property and protect against unauthorized use or distribution. If you wish to purchase a discounted license extension after your 3-year period expires, you will use a temporary, 6-digit Renewal Code displayed directly within the Software.

9. Support Limitation

Direct 1-on-1 technical support is explicitly NOT included in the purchase price. We provide comprehensive self-service resources, including a knowledge base and video tutorials, to assist you with installation and usage.

10. Absolute Limitation of Liability (Data Loss)

The Software is provided "as is" without warranty of any kind. Under no circumstances shall Weber IT, its developers, or affiliates be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Software.

Data Protection Waiver: You acknowledge that the Software interacts with your personal text and Markdown files within Obsidian. We strongly advise maintaining regular backups of your Obsidian vault. In no event shall we be held liable for the loss, corruption, deletion, or modification of your personal notes, data, or local files under any circumstances.
